Apex court stays HC order that quashed revised seniority list

The Supreme Court has stayed the High Court order on seniority list. The Supreme Court has ordered status quo to be maintained and has also granted leave in the matter.
Two special leave petitions have been filed by Arun Desai and Sandeep Jacques before the Supreme Court against the High Court order of quashing the revised seniority list. After hearing the counsel for the petitioners the Supreme Court has stayed the High Court order on seniority list giving relief to Arun Desai and Sandip Jacques.
In the seniority list dated June 24, 2014, Elvis Gomes, who was the director of municipal administration was at number 2 after Swapnil Naik and in the revised list issued on August 19, 2014 Gomes was pushed to the fourth place and Sandeep Jacques is placed first, followed by then transport director Arun Desai, following representations submitted by the two. After the High Court quashing the revised seniority list Elvis Gomes has come back at number 2 after Swapnil Naik and at number 3 is Sandeep Jacques and on number 4 is Menino D’Souza.
The government while issuing the list on June 24, 2014, had in the remark column stated that the “seniority list finalised vide memorandum No 5-7-99 PER (Vol I) dated June 19, 2002 and will remain undisturbed” but chose to change the list after accepting the representations made by the two officials. Elvis Gomes had also filed a petition on urgency before the High Court that there is a possibility of sending the list dated April 30, 2015 to the UPSC apart from challenging the seniority list before the court.
