HC quashes state govt’s revised seniority list

The High Court of Bombay at Goa has upheld Elvis Gomes’ contention over the seniority list. A senior bureaucrat of the Goa civil services, Elvis Gomes had moved the High Court challenging the seniority list issued by the state government.

In the seniority list dated June 24, 2014, Gomes, who was the director of municipal administration, was at No 2 after Swapnil Naik and in the revised list issued on August 19, 2014, Gomes was pushed to the fourth place and Sandeep Jacques was placed first, followed by then transport director Arun Desai, following representations submitted by the two.

Now, after the High Court quashing the revised seniority list, Elvis Gomes has come back at No 2 after Swapnil Naik and at No 3 is Sandeep Jacques and at No 4 position is Menino D’Souza.

While issuing the list on June 24, 2014, the government had in the remark column stated that the “seniority list finalised vide memorandum No 5-7-99 PER (Vol I) dated 19/6/2002 and will remain undisturbed” but chose to change the list after accepting representations made by the two officials.

The biggest losers of the new government decision were Elvis Gomes, who was then the director of Municipal Administration, and Menino D’Souza, then excise commissioner, who were second and fourth in the previous seniority list and were later placed at fourth and fifth positions.

Elvis Gomes had also filed a petition on urgency that there is a possibility of sending the list dated April 30, 2015, to the UPSC, apart from challenging the seniority list before the court.
