The witness for the state of Karnataka Professor A K Gosain, in the Mhadei water dispute, was extensively cross-examined further on Tuesday by Atmaram N S Nadkarni, senior counsel, appearing for Goa before the Mhadei Water Dispute Tribunal.
The apparent contradictions in his report and in his answers were shown to him and he was confronted with the same.
At one point of time, the witness said that he did not have access to raw data, however, when the Central Water Commission (CWC) report, which contains raw data and on which the witness relies upon, was shown to him, the witness thereafter changed his answer to state that the data was not given to him in digital format and that the data in the CWC report was illegible.
The tribunal, taking serious note of this contradiction, posed him a question as to how if the data was illegible, in his affidavit and report and in most of the questions in the cross examination he has stated that he has thoroughly examined it.
On Monday, the tribunal had posed a question to the witness as to how he has copy pasted anything else apart from what was highlighted by the state of Goa. To this, the witness answered saying that he has not done so.
However, the tribunal as well as the senior counsel Nadkarni pointed out several other paragraphs which the witness had copied from CWC report of 2014. To this as well, the witness gave a very evasive answer without answering the question.
The tribunal infact commented on the demeanor of the witness.
The witness further clearly agreed that he has not done any processing of data till 2001 and he has merely relied upon the processed data of CWC.
After the state of Goa clearly showed the apparent fallacies in the processing of data by the CWC to the witness, he answered by saying that he can’t answer the same because the same was done by the CWC.
Some of the questions, which were posed to the witness based on his own report and CWC report, which he claims to have examined thoroughly, could not be answered by him and the witness said he will need time to answer the same and will be answered on March 31, 2017. The witness would be further cross-examined.
